Twenty-Five Properties to be Sold at Auction on March 26

BERRYVILLE, VA (March 6, 2020) More than two dozen Clarke County and Berryville properties will be sold at public auction later this month. The Tax-Delinquent Real Estate Auction includes 22 lots in the mountainside community called Shenandoah Retreat, one property within the Town of Berryville, and two other parcels in the county. 

The auction, managed by the Richmond-based law firm of Sands Anderson PC, begins at 1 p.m. Thursday, March 26, in the second-floor meeting room of the Berryville-Clarke County Government Center located at 101 Chalmers Ct. in Berryville. Interested individuals must be present at the live auction in order to bid.

Current owners of these properties have received at least 12 notices regarding taxes owed, said Clarke County Treasurer Sharon Keeler. Regular tax bills are mailed twice every year to all property owners, followed by delinquent notices when applicable. Clarke County does not sell properties at auction until at least three years have passed with no tax payments made. After three years, the Sands Anderson law firm contacts property owners in an effort to collect unpaid taxes.

“We would rather work out any type of payment plan with an owner before selling their property at auction,” Keeler said, noting that the Code of Virginia allows properties to be sold after only two years of non-payment.

All sales are subject to the approval of the Circuit Court. A 10 percent Buyer’s Premium is added to the highest bid and becomes part of the total sales price on each property. The highest bidder must deposit 10 percent of the total sales price, either cash or good check, which is credited toward the purchase at closing. The balance of the purchase price — in cash or certified funds — must be deposited within 15 days of Court confirmation with Special Commissioner Margaret F. Hardy of Sands Anderson PC. 

All properties are conveyed by Special Warranty Deed subject to any easements and covenants of record, and any rights of persons in possession. Announcements made the day of sale take precedence over any prior written or verbal terms of sale.

Potential buyers may go onto the unimproved lots in order to make inspections.
