Board of Zoning Appeals

Purpose:               

To decide on applications for variances from Zoning Ordinance regulations when a literal enforcment of the Ordinance will result in a hardhsip approaching confiscation of the use of a property (as opposed to a convenience).

To decide on appeals from the decisions of the Zoning Administrator or any order, requirement, decision, or determination made by an administrative officer in the administration or enforcement of the Zoning Ordinance.

To decide on interpretations of the Zoning Map where there is any uncertainty as to location of a zoning district boundary.

To decide on applications for such special exceptions as may be authorized in the Zoning Ordinance.

Membership:         

The Clarke County Circuit Court appoints the five members of the Board for four year terms based on recommendations of the Board of Supervisors.  One of the five Board members is also a member of  the Planning Commission.  Click here for current members.

Planning Commission

Purpose:         

Promote the orderly development of the County through appropriate land use designations, provision for public services and utilities, and protection of the environment and cultural resources.   The Commission recommends to the Board of Supervisors a County Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and other related ordinances to achieve this goal.

Membership:   

The eleven Commission members are appointed by the Board of Supervisors (two from each election district) for a term of four years, with a member of the Board also serving as a Commission member.  Current Planning Commission members

Meeting Information:            

Meets the first Friday each month at 9 am in the Board of Supervisors Meeting Room [No regular meeting is conducted in August]

Briefing Meeting is held the Tuesday before the first Friday of the month at 3 pm in the Board of Supervisors Meeting Room

Conservation Easement Authority

Purpose:         

To protect and preserve land with significant agricultural, natural, scenic, and historic resources, specifically including:
  1. quality farmland;
  2. land providing open-space and rural character;
  3. environmentally sensitive areas important to water quality, plant life, and wildlife;
  4. historic resources;
  5. natural and scenic resources;
  6. land that promotes tourism; and
  7. water resources.
To achieve these purposes the Authority:
  1. Can acquire and/or receive conservation easements, by purchase, gift, or other conveyance;
  2. Can hold and enforce conservation easements conveyed to it;
  3. Administer the Clarke County Conservation Easement Purchase Program pursuant to Chapter 72 of the Clarke County Code; and to exercise any powers authorized by the Public Recreational Facilities Authorities Act.
Membership:   

The seven members are appointed by the Board of Supervisors and are comprised of:
  • one member from the Board of Supervisors, (with a one year term,
  • one member from the Planning Commission, (with a one year term) and
  • five County citizens (with three year terms)

Board of Septic and Well Appeals

Purpose:         

To decide appeals from any order, requirement, decision or determination made by the Clarke County Health Department in the administration or enforcement of Code of Clarke County Chapter 143 Septic Ordinance.

To decide applications for variances in accordance with the provisions of Code of Clarke County Chapter 143 Septic Systems.

Membership:   

The Board of Supervisors appoints the three members of the Board of Septic and Well Appeals:
1)  the member of  the Board of Supervisors, who serves as the Board's liaison to the Planning Commission, with The Vice Chairman of the Board designated as his/her alternate,
2)  the chair of Planning Commission with the vice chair designated as his/her alternate, and
3)  a member of the public, who is a resident of the County, with the vice chair of the Planning Commission designated as his/her alternate.

To be eligible for a variance from the Board of Well and Spetic Appeals you must meet one of the 5 following criteria.

Variance criteria.
  1. A habitable building for which the variance is requested is currently occupied.

     

  2. A habitable building has been destroyed by circumstances beyond the control of the owner or occupant of the building within one year of the variance application.

     

  3. The building is eligible to be on the Virginia Landmarks Register or the National Register of Historic Places or is eligible to be a contributing property in an historic district listed in the Virginia Landmarks Register or the National Register of Historic Places.

     

  4. The variance is requested so as to provide for septic systems or water supply systems replacing existing septic systems or water supply systems that are more consistent with the regulations of this article.  A habitable building must be located on the property with the existing septic system or water supply system.

     

  5. The entire parcel of land has been placed under a permanent conservation easement granted to the Clarke County Conservation Easement Authority, Lord Fairfax Soil and Water Conservation District, Virginia Foundation and/or Virginia Board of Historic Resources.

Historic Preservation Commission

Purpose:

Inform and educate the public about the historic and cultural resources of the County. To review projects and developments that may change or alter the historic character of historic districts designated by the County.

Membership:

The Board of Supervisors appoints the seven members of the Commission for four year terms. One member is also a member of the Planning Commission. One member must be either an architect or an architectural historian.
